Developer Cost Sharing Agreements
We have been involved in numerous inter-developer cost sharing agreements, in the roles of negotiator, author and trustee. We also review cost sharing agreements and provide input on behalf of individual clients. Our work includes negotiating front-ending agreements on behalf of developers and municipalities.
The cost sharing agreements for which we are responsible are varied in both size and scope. Some agreements are short term front-ending agreements, e.g. two or three participants and a limited number of services. Other agreements have involved upwards of 15 parties and require the sharing of multiple land and servicing accounts for both residential and commercial landowners. These agreements deal routinely with:
• Pooling of development charge credits
• Funding and construction of spine services, management and disposition of community land such as school blocks
• Oversizing of services to benefit external lands to service the community in question
• Joint construction projects with regional and municipal governments
• Implementation of environmental protection settlements
• Identification, monitoring and administration of reserve land accounts pending future policy initiatives which will allow development to proceed
